The following terms and conditions apply to all services offered by S8 Design and are put in place to protect both the client and ourselves. Upon signing our 'proposal document' you are agreeing to the following terms and conditions.

1. We reserve the right to refuse to add web site content which we judge as unfit for public consumption. This includes, but is not limited to, adult oriented material such as pornography, material which promotes hatred towards persons belonging to any ethnic group, religion or sexual orientation and material which infringes copyright.
   
   
2. The acceptance of a commission shall be deemed as a contractual agreement between the client and S8 Design. This agreement is formed upon signing our 'proposal document'
   
   
3. S8 Design reserves the right to postpone a project in the event of exceptional circumstances that are beyond our control. We will endeavour to arrange a new starting date as soon as normal service is resumed.
   
   
4. All material, both text and images supplied by the client and used in the construction of the client's web site, will remain the client's property. All such material will be assumed to be the property of the client and free to use without fear of breach of copyright laws.
   
   
5. The copyright for all material provided by S8 Design, such as HTML code, graphics, photographs and text, will remain the property of S8 Design until such time as payment has been made in full whereupon they will become the property of the client.
   
   
6. S8 Design makes every effort to design pages that will display acceptably in the most popular current browsers, but cannot accept responsibility for pages which do not display acceptably in new versions of browsers released after pages have been designed.
   
   
7. S8 Design will submit a client's website to several of the major search engines as part of the design commission. Each page can be optimised to perform better in search engine rankings for an additional charge. Under this service, we will make every reasonable effort to design the website with this in mind but cannot guarantee high placings in search engine results as these are ultimately beyond our control.
   
   
8. S8 Design can accept no responsibility or liability if any search engine, online directory or search site chooses not to list a client's web site. However we will try to rectify the problem if it is caused by an element of our site design.
   
   
9. We cannot accept responsibility for website downtime on our shared hosting plan. We can setup a private server for an additional charge at your request.
   
   
10. If at any point during the Project Development Cycle a client wishes to suspend or cancel the project, they may do so but will be invoiced an amount that S8 Design judges to be proportional to the amount of work completed up to that point.
    
    
11. If, during the Project Development Cycle, the client does not supply the content required in order to complete the commission for a considerable length of time, S8 Design reserve the right to invoice the client for any work which has been done and postpone the project until such time that the content is made available to us.
    
    
12. S8 Design expects payments to be made within a reasonable time from the invoice date. Payments can be made by cheque, cash or bank transfer. In the case of a website, the completed site will be password protected until payment has been made in full. S8 Design reserves the right to shut down or suspend the site completely without notification if full payment has not been recovered in the reasonable time as aforementioned.
    
    
13. It is the client's responsibility to ensure payments can be made with their chosen method of payment. Any charges incurred due to bounced payments will be invoiced to the client.
    
    
14. S8 Design does not automatically undertake maintenance or updates to a client's website as part of the initial design commission. If a client wishes for updates to be made on a regular basis, S8 Design will propose a maintenance contract appropriate to the amount of work required. Prices will be in accordance with our current 'Services' tariff.
    
    
15. S8 Design reserves the right to alter prices at any time without notice. If a client has commissioned any services from S8 Design prior to a change in prices, that commission will not be subject to any increase.
    
    
16. By agreeing to these terms and conditions your statutory rights are not affected.

S8 Design reserves the right to change or modify these terms and conditions. Make sure you read through thoroughly and agree to these terms before entering into a contract.
